There are many types of covenant, but generally we deal with protective covenants. If you have an area of native bush, a natural wetland, a unique type of vegetation or a habitat for one of New Zealand’s native species that you would like to be protected, a protective covenant is an option.
Each case is looked at individually, but a survey can be carried out with a special plan diagram drawn or sometimes an aerial photo with the plan diagram is accepted. This is then legally registered on the Certificate of Title at Land Information New Zealand (LINZ).
It is possible to apply for financial assistance, to help with fencing and maintenance of the covenanted area, through District and Regional Councils or the QEII National Trust.
A covenant could be used in the potential subdivision of land with possible exchanges of land with the local Council to remove the need for a potential reserves contribution.
